Terms and Conditions (T)
These TCs apply to hikes, treks, snowshoe tours, courses, events, consultations, and other activities both domestic and abroad – hereinafter collectively referred to as “Tour”, provided by mystery-hikes.ch – hereinafter referred to as the “Organizer”. Individual Tours are exclusively subject to Swiss law, even if they are performed entirely or partially abroad.
Guest registration can be done in writing via email, booking form, WhatsApp, social media, postal mail, or verbally. The contract is concluded as soon as a written confirmation has been sent by the Organizer to the guest via email or WhatsApp. From this point onwards, the registration is binding. By registering, these “Terms and Conditions” are accepted as part of the contract between the guest and the Organizer. The Organizer reserves the right to reject Tour registrations without stating reasons.
By registering, the guest confirms to meet the physical and technical requirements as per the respective description – any allergies or other relevant health impairments should be communicated to the Organizer upon registration. Should the guest not meet the physical and technical requirements, the Organizer may exclude them before or during the Tour. In case of exclusion for the aforementioned reasons, no refund will be issued.
Each Tour requires appropriate equipment, which is listed in a detailed equipment list. This equipment list must be fulfilled by the guest no later than the start of the Tour and may be inspected by the Organizer. If the guest’s equipment does not comply with the equipment list, the Organizer may exclude them before or during the Tour. In case of exclusion for the aforementioned reasons, no refund will be issued.
The guest is obliged to strictly follow the Organizer’s instructions during the Tour. In case of non-compliance, the Organizer is entitled to immediately terminate the Tour, and the guest is obliged to pay the full agreed remuneration. Unless otherwise stated, guests must be at least 18 years old.
The services included in the price may vary depending on the offer. These are listed in the short description of each offer. The price always excludes travel to and from the destination, mountain railways, taxis, snacks and drinks, rental equipment, and insurance, unless explicitly mentioned in the description. Prices are per person in CHF.
Tours generally take place in all weather conditions. However, weather conditions or the participants’ physical condition may lead to short-notice changes in the program, area, or route. The participant accepts such changes made by the Organizer. Any additional costs for travel, accommodation, and meals shall be borne by the participant.
The Tour will only take place with the specified minimum number of participants.
The hike must be paid for at least 30 days before the Tour. If registration occurs at short notice, the amount must be paid immediately. If payment is not received on time, the Organizer may terminate the contract and demand cancellation fees as per the section “Cancellation by the Guest”.
Participants can pay via TWINT to 076 5045033 or by bank transfer (UBS): IBAN CH48 0025 5255 1119 4840 Z
Any cancellation of the Tour must be reported by the guest in writing via email or postal mail. The cut-off date is the first working day after receipt of the written cancellation. In any case, a processing fee of CHF 50.00 will be charged.
The following cancellation fees apply:
60 – 31 days: 20% of the price
30 – 20 days: 50% of the price
19 – 10 days: 75% of the price
9 – 0 days: 100% of the price
In case of premature termination of the Tour by the participant, the full package price is due. In this case, there is no right to a refund. For multi-day tours in Switzerland and abroad, the cancellation conditions of the respective advertised Tour apply.
If a Tour is cancelled at short notice by the Organizer due to exceptional circumstances (e.g., high avalanche danger, severe weather, illness, family events), poor conditions, or insufficient number of participants, the entire amount paid will be refunded. Further claims are excluded. In case of premature Tour termination due to force majeure, there is no right to a refund.
Accident, health, liability, and theft insurance are the responsibility of the guest. REGA patronage and the conclusion of a cancellation insurance are strongly recommended.
LIABILITY
The qualified Tour leadership offers the guest the greatest possible safety. However, the particular dangers in nature and in the mountains do not rule out a residual risk. By registering, the guest expressly acknowledges these dangers. The Organizer’s liability is excluded for slight negligence, fault of the participants, third-party fault, and force majeure.
The Organizer is not liable for theft, loss, or damage to personal and rented equipment.
During the Tours, photos and videos will be taken by the Organizer and guests, which may visibly show individual persons. The Organizer reserves the right to use the imagery for marketing purposes (analog digital). If photos and videos of guests are not to be used for marketing purposes, or if a guest does not wish to appear in photos and videos, they must inform the Organizer of this no later than the start of the Tour.
Customer data will be used for processing registrations, for communication before, during, and after the Tour, as well as for sending newsletters, blog articles, and other hiking-related information. Furthermore, customer data (name, first name, and WhatsApp number) will be shared among all participating guests to ensure seamless communication during the hike. Guests who do not agree to the sharing of this data with other participating guests must note this in writing upon registration.
The contractual agreement is subject to Swiss law. The place of jurisdiction is Zug (ZG).
